Thank you for having me present on behalf of the Parks Atlanta Rescue Coalition (PARC) to the Buckhead Council of Neighborhoods last night.  I very much appreciate the opportunity and hope that the Council will see fit to endorse the PARC 2009 Act to Save Atlanta's Parks (ASAP)!  As promised, I have attached an electronic copy of the endorsements sheet [pdf], as well as the 4-pager that describes the PARC 2009 ASAP! 2. Retroactive Fulton property tax bill bites homeowner again
 
Robert Sarkissian, North Buckhead Civic Association's Traffic Committee Chair writes:
Recall last September when many of us received our 2008 property tax bills, a paragraph was included stating that back taxes were owed.  There was no updated tax bill or any other reason explained, just a sentence stating that (in my case) I owed some $1,400 in back taxes.  I know this didn't apply to everyone but some 7000 of us complained to the Fulton County Taxpayers Foundation and eventually a lawsuit was filed and we won (December).

 
On Saturday I received a delinquency notice from my mortgagor WuMu stating they had paid the those taxes and I now owe WaMu $1,607 including late fees and penalties. To date I have not received any correspondence from either WaMu's tax revenue dept or the county. They just went ahead and paid it on my behalf.  [Apparently Fulton never updated their tax records to reflect the fact that they lost the lawsuit. -GC]

 
This morning when I called WaMu they explained that there was no statement or correspondence at all with the City or Fulton County.  An independent firm they hired checks the tax web sites for all properties they have interest in and found the $1,607 shortage on my 2007 property tax.  I must pay WaMu and then fight the county for a credit.  So please check into all your prior years taxes on the web site if you received a similar notice.  [I don't know exactly how you would check this; if someone else has paid the taxes you don't owe, there won't be a balance due. -GC]
3. Duck Pond Garden Tour & Artist Market
 
Virginia Gunn, Communications Chair for the Peachtree Heights East Neighborhood Association (PHENA) provided the following announcement:
Peachtree Heights East (between P'tree Hills & Garden Hills) is turning 100 this year, and to celebrate we are having our first ever Duck Pond Garden Tour & Artist Market. The Tour and Market are on Sunday, May 17th from 11am - 5pm.
 
There are eleven (11) great gardens on the tour, sponsored by some of the best landscape designers, outdoor furniture retailers, interior designers and event planners in Atlanta. In addition to the beauty of the Spring foliage, the garden will also be decorated for special events and outdoor entertaining. The gardens will be an inspiration and offer ideas not only for gardening, but for outdoor entertaining as well. Our Duck Pond Park will be the gathering area for the Duck Pond Market featuring many different artists, food by Soiree, refreshments, garden presentations, music and garden-themed children's activities. CALL TO ACTION FOR DEPARTMENT OF WATERSHED MANAGEMENT: SIGN PETITION NOW!
 
We have all heard the troubles that residents across the city have experienced with the Department of Watershed Management (DWM) about unresolved billing issues and unreturned deposits. Your Buckhead Council of Neighborhoods (BCN) is working for you and actively trying to resolve these issues by collecting names and information in a formal PETITION to submit to the DWM Commissioner and City Council representatives for immediate and specific action.

ATLANTA (May 26, 2009) - Do you know an everyday hero who is making great strides today to ensure a greener tomorrow?  WSB-TV Channel 2, in partnership with The Trust for Public Land (TPL), today launched Cox Conserves Heroes - Atlanta, a national awards program to honor and celebrate conservation in everyday life.   
 
Cox Conserves Heroes-Atlanta is now accepting nominations at www.wsbtv.com/community. The Cox Conserves Hero, chosen by online consumer voting, will be awarded $5,000 to donate to the environmental nonprofit of his or her choice.

To the editor:

When bond-rating agencies tell us Atlanta has a fundamental financial problem going well beyond the recession, we need to be asking better questions of our local politicians. It's high time the mayor and council explained to long-suffering residents and taxpayers why the city's rapid growth this decade has not resulted in higher tax revenues. Property tax revenue was $140 million in 2002 and only $138 million in 2008. Yet the property digest was way up over these years, and we have 25 percent more residents, according to the mayor. Sure, there have been millage rollbacks, but half the digest growth is from new construction, which should have resulted in new revenue. So where did the tax growth go?

Some money has gone to the tax allocation districts (TADs), disingenuously sold to residents as a free lunch. We now learn that to replace those revenues we all have to pay higher taxes. Yet so far "only" $13 million per year of city tax money is going to the TADs. TADs are not yet a big reason for revenues going missing, but as a higher proportion of future growth occurs in the TADs, the budget bleeding will become more severe.

Some revenue may have disappeared as tax deferrals to developers, but finding the truth on that seems next to impossible. We know the Fulton County Development Authority has awarded massive tax favors to high-rise developers, but do those deferrals also apply to city property tax? The Atlanta Development Authority does not seem to report anywhere what its and Fulton's concessions cost the city. The lack of transparency and accountability should worry residents.

A lot of tax seems lost to nonpayment. The city reported $30 million of unpaid tax in 2007. Yet the state's figures show that Atlanta should have received $202 million in property tax in 2007, against $125 million actually collected, according to the city, a far wider gap. Why are tax liens not working to recoup money owed to the city? Sure, the Fulton tax commissioner is in charge of collections, but how is the city working with him to rectify these enormous losses? Failure to collect tax from deadbeats leaves the rest of us to pay more than our share.

We also need an explanation of the relative stagnation of sales tax revenue, up only 9 percent from 2002 to 2008. Consumer price inflation alone was higher than 9 percent over the period. The influx of new residents, more prosperous than average, and the consumer binge of the Bush years should have pushed retail sales growth far above 9 percent. Where did the sales taxes go?

A fair test of whether candidates for city office deserve our vote will be whether they answer this elementary question: Why is the city starved for revenue after the growth surge we experienced this decade, and what will you do to change that?

Jim King called the meeting to order at around 6:40 PM. A quorum was achieved by speaker phone at one key
point in the meeting.

II. Secretary’s Report
Minutes for the April board meetings were not approved by the Board because of a lack of quorum.
III. Treasurer’s Report
The treasurer made no report. [The BCN has $2,000 in
the bank and $300 in checks in hand (Paces West needs
to remake their check to “BCN”).]
The map at the right shows the continued expansion of
BCN membership (light red).
IV. Speakers
Note on Presentation Reports: For simplicity in reporting, the material reported
below is usually reported from the point of view of the speakers. These reports
reflect the opinions of the individual presenters and may not necessarily be the
position of BCN or its member associations.
a. Kristy Gilmann, President, Peachtree Hills Civic Association, Proposed Water Meter Petition
At the beginning of the meeting there was standoff between a Channel 11 reporter/camera team and Peachtree
Pres security. The 11Alive team intended to report the BCN deliberations on the problems resident have had with
the Department of Watershed Management. These problems include unreturned deposits and malfunctioning
water meters, some of which are equipped with mismatched components and issue incorrect readings. The
cameras were not permitted to enter the building because their presence had not been approved in advance by
church officials, as required by church policies. Nevertheless, the 11Alive news at 11 prominently reported the
actions of the BCN board although without pictures. (Related article and video at
http://www.11alive.com/rss/rss_story.aspx?storyid=130127. A cellphone video taken of the 11Alive report after
this meeting is on our web site at .)
The board made refinements to the draft petition that Kristy had prepared. Henry Wyche participated by
speakerphone to achieve a quorum. With Henry’s vote, the board in attendance unanimously endorsed the
proposed petition. The petition, as approved by BCN, is attached (Attachment 1). This petition is to also be
approved on-line by Buckhead residents who believe they have experienced inaccurate DWM meter
readings/billings. They will be able to use Peachtree Hills’ web site to record their contact information and
complaints against DWM (as outlined at the top of page 1 of Attachment 1) and to approve the petition.
Kristy was designated BCN’s official representative to the Atlanta Department of Watershed Management.
b. Gordon Certain, President, North Buckhead Civic Association, How Fulton County Property
Tax Values are Set
Gordon gave a Powerpoint-style video presentation of his research on how Fulton County property tax property
appraisals are calculated. Building and land values appear to be set by predetermined formulas, equations, and
tables. A key element of this system is the notion of “neighborhood codes” which are 4 to 6 digit numbers which
are assigned to geographical areas that generally do not correspond to recognized neighborhoods such as North
Buckhead or Paces. The principal faults of this system are that abrupt (as opposed to progressive) valuation
changes are experienced at neighborhood boundaries. Other deficiencies are doubts about the statistical validity
of the system and the lack of consideration of the building’s age. It does not appear that selling prices or
construction costs of individual properties have any bearing on the valuations set. It appears that some

“neighborhood codes” result in significant under-valuation or over-valuation of groups of properties. Appeals in
some areas (those already under-values) may not achieve the hoped-for results.

V. Community Concerns
Elections
There was a discussion about how BCN might be involved in candidate interviews or forums.
Jim suggested that once candidates are qualified in early September that BCN could pursue
having them participate with BCN individually or as a group.
Survey of Neighborhood “Best Practices”
Craig C. Perry, President of West Paces Northside suggested that neighborhoods have different
strengths and that it might be useful to identify what different neighborhoods do to achieve high
levels of neighborhood membership and participation. Craig will prepare a survey to be circulated
to BCN member associations during the upcoming month.
VI. Committee Reports
a. Public Safety: There were reports of high frequencies of burglaries in Buckhead
neighborhoods.
b. Transportation: No report
c. Education: No report
d. Parks: No report.
VII. Updates and Announcements

RESOLVE COMPLAINTS TO DEPARTMENT OF
WATERSHED MANAGEMENT NOW!
SUMMARY OF THE PROBLEM:
A large majority of Buckhead residents with incorrect billings and unreturned deposits are
not getting timely resolution to calls, emails, or letters of complaint to the City of Atlanta
Department of Watershed Management (DWM). In many cases, residents’ communications
are either unacknowledged by the DWM or the resident is being told that no workable
solution is possible. For a large number of residents, attempts at appropriate resolution
have been ongoing for up to 8+ months with no end in sight. Many Buckhead residents
have experienced pressure tactics from the City to pay bills regardless of their accuracy—or
run the risk of a disconnection of water services. In some cases, disconnection has
occurred even after payment of incorrect bills.
With DWM officials publically recognizing that there have been issues with billing processes,
meter equipment, and estimated meter readings, the treatment of our residents is appalling.
Furthermore, with the recent completion of the KPMG performance review of DWM, it is
apparent that the DWM is experiencing extensive problems with billing procedures and
resolution practices that are inconsistent across residents’ complaints.

• Requesting DWM to assign a departmental representative to spearhead resolution of
the complaints from the residents included in this petition; with such representative to
be named within 30 days of receipt of this petition;
• Requesting that the DWM representative report monthly on previous month’s
activities and resolved/closed cases to Kristy Gillmann, BCN representative;
• Asking for DWM to issue written confirmation to each account holder in the petition
that the DWM recognizes the account is in official “dispute” status and verifies that
the resident is not at risk of having his/her water services disconnected during the
dispute period. Written confirmation should to be mailed to residents within 45 days
of receipt of this petition;
• Commitment by DWM that the representative assigned will work diligently to resolve
billing/deposit disputes of BCN residents within 90 days of receipt of this petition;
• Asking our elected city council representatives to join in this petition and facilitate
resolution with the DWM
• Encouraging letters of support for this petition from fellow neighbors, civic and
business leaders.
The Buckhead Council of Neighborhoods hereby goes on record that a solution to each

The Buckhead Council of Neighborhoods (BCN), Trinity Presbyterian Church, Ahavath Achim Synagogue, and St. Anne's Episcopal Church Sponsor Atlanta Mayoral Forum
 
Atlanta, GA -- September 8, 2009 --The Buckhead Council of Neighborhoods and Trinity Presbyterian Church, along with other neighboring houses of worship including St. Anne's Episcopal Church and Ahavath Achim Synagogue, will jointly sponsor an Atlanta Mayoral Forum at Trinity Presbyterian Church, 3003 Howell Mill Road, on Tuesday, September 22 at 7:00 PM.  Confirmed participants include Atlanta mayoral candidates Lisa Borders, Mary Norwood, Kasim Reed and Jesse Spikes.  The event is free and open to the public, and local political commentators Bill Nigut, formerly with WSB-TV and current Regional Director of the Anti-Defamation League, and Dick Williams, host of Fox 5's Georgia Gang, have agreed to moderate the Forum.
 
The sponsoring groups are extremely pleased that the top four mayoral candidates will appear to address residents' questions and concerns on such key issues as public safety, taxes, finance, parks, schools and transportation.  The evening will encourage both the candidates and the audience to focus on issues that are specific to the Buckhead area as well as issues important to all Atlanta. 
 
Questions are being submitted in advance by neighborhoods and the faith community.  In addition, residents will be able to submit questions on the night of the event on provided index cards.  Moderators Nigut and Williams will pose questions to the candidates throughout the evening, which is expected to last two hours.
 
Jim King, chairman of the Buckhead Council of Neighborhoods and president of Chastain Park Civic Association, said "The upcoming mayoral race is extremely important to the future of the areas represented by the BCN.  In November, we will have a chance to make our voices heard.  We hope that the Atlanta Mayoral Forum will generate a lot of interest, excitement and debate about the upcoming election and contribute to greater turnout at the polls."

As chair of BCN's Parks Committee, I'd like to pass on some announcements related to upcoming events.

Upcoming Parks-Related Events

  The Commissioner's Council on Parks, Recreation and Greenspace - February 10


Acting Commissioner Paul Taylor will hold his first quarterly meeting with NPU and neighborhood representatives on Wednesday, February 10, 2010, 5:30 PM to 7:30 PM.  The meeting is held in the Commissioner's Conference Room, City Hall East, 8th Floor, 675 Ponce de Leon Avenue NE, Atlanta, Ga 30308.

I have attended these meetings for several years and have found them helpful in understanding the Parks Department, learning about its initiatives, and getting to know their people.  This meeting should be especially important since it will be Paul Taylor's first as acting commissioner.


  Charlie Loudermilk Park (Buckhead Triangle Park) - Public Meeting - February 10


According to the flyer Andrea Bennett sent, there will be a public meeting in Room 4204 at the Peachtree Pres "Lodge" (3417 Roswell Road) at 6 PM on Wednesday, February 10.  The meeting will discuss a project to re-design this park at the intersection of Peachtree and Roswell Roads.  You will be given the opportunity to "offer your comments and concerns".  The event is an initiative of the Buckhead Alliance.


  Arthur M. Blank Family Foundation - Richard Louv webcast - February 16


According to the flyer Henry Wyche sent, "The recipient of the 2008 Audubon Medal, Richard Louv identified a phenomenon we all knew existed but couldn't quite articulate: nature-deficit disorder. Since its initial publication, his book Last Child in the Woods has created a national conversation about the disconnection between children and nature, and his message has galvanized an international movement. Now, three years later, we have reached a tipping point, with the book inspiring Leave No Child Inside initiatives throughout the country."

Full schedules for the tours are available as downloads on this page.  [According to my wife Sue, who has a plot there, the Blue Heron Nature Preserve's Community Garden is one of the gardens on this tour.  Blue Heron is a 25-acre nature preserve in North Buckhead on Roswell Road near Pike's Nursery.  The "wetlands" portion of the preserve can be accessed from the cul-de-sac on Emma Lane.]
The e-mail reminder I received says to register by February 5 to get the $89 early bird rate for the conference.  The date is Feb. 4 according to the web site, so you might want to enroll it soon.
